Terms and Conditions of Sale

1. Preamble

These terms and conditions of sale are published by the micro-enterprise ELLADA, registered with the Marseille Trade and Companies Register under number 853 347 144. Its registered office is located at 20, rue Nicolas Appert, 13013 Marseille, France.

The Customer acknowledges and declares that they:

  • are of legal age and legally capable of entering into a contract;
  • understand that confirming an Order constitutes acceptance of these Terms;
  • are acting as a final consumer, unless stated otherwise.

The Customer may save and print these Terms using their browser or computer.

2. Definitions

  • Terms of Sale: these terms and conditions of sale.
  • Customer: any adult natural person placing an Order for personal use.
  • Order: the purchase of one or more Products via the Site, with no account required (guest checkout).
  • Personal Data: information directly or indirectly identifying a person.
  • Products: items available for sale on the Site.
  • Site: https://lolivequivoyage.fr

3. Purpose

These Terms set out the conditions of sale for Products available on the Site: the various stages of an Order, the formation of the sales contract, and the respective rights and obligations of the Parties.

4. Acceptance of these Terms

These Terms apply as soon as the Customer confirms an Order. ELLADA reserves the right to amend them at any time; only the version accepted at the time of the Order remains applicable. These Terms are available at any time on the Site under "Terms and Conditions of Sale".

5. Orders

5.1. Order steps

To place an Order, the Customer follows these steps:

  • selecting the Product and size (3L or 6L),
  • adding it to the cart,
  • reviewing the order summary (quantities, price, estimated shipping),
  • entering a delivery address,
  • secure payment via Stripe,
  • order confirmation.

No account is required: Orders are placed as a guest. By completing these steps, the Customer confirms the accuracy of the information provided.

5.2. Order confirmation

Once payment is confirmed, ELLADA sends a confirmation email summarising the Order. If the Customer does not receive this email, they are advised to check their spam folder or contact the company.

An Order may be declined if a product is temporarily out of stock or the delivery address is clearly incorrect.

5.3. Order tracking

Once the Order has shipped, any available tracking information is sent by email.

5.4. Personal data

ELLADA collects and processes data in accordance with the GDPR. For more information, see the Privacy Policy.

6. Prices

Prices are shown in euros, all taxes included. VAT not applicable, Article 293 B of the French General Tax Code (ELLADA is exempt from VAT). Delivery costs are shown separately before final payment (see article 8). Prices may change at any time; the price applicable is the one shown when the Order is confirmed.

For deliveries outside the European Union, the Customer is responsible for any customs duties and taxes.

7. Payment

The Customer pays for their Order by credit card, via the secure Stripe payment platform. ELLADA never receives or stores any card details: this information is exchanged only between the Customer's browser and Stripe. Payment must be confirmed for the Order to be considered final. An invoice is sent by email on request to contact@lolivequivoyage.fr.

8. Delivery or pickup

8.1. Available options

  • Delivery to France and the following countries, via Mondial Relay: Austria, Belgium, Germany, Italy, Luxembourg, Netherlands, Portugal, Spain.
  • In-person pickup: 20 rue Nicolas Appert, 13013 Marseille (by appointment).

Shipping costs are €2 per kilogram to the countries listed above. Delivery is free within the Bouches-du-Rhône (13).

8.2. Timeframes

Shipping timeframes are communicated in the confirmation email. They depend on the carrier and may vary with stock levels and season.

8.3. Receipt

The Customer must check the condition of the parcel on receipt and note any issue in writing on the carrier's delivery slip. Risk transfers to the Customer (or a third party they designate) as soon as they take physical possession of the Products.

9. Right of withdrawal

The Customer has 14 days from receipt of their Order to exercise their right of withdrawal, with no need to justify a reason or pay a penalty, under Articles L221-18 et seq. of the French Consumer Code. This right applies only to unopened, unsealed boxes: once a box is opened, the food product can no longer be returned for hygiene reasons (Article L221-28, 5° of the French Consumer Code).

10. Warranties

Products comply with French regulations. The Customer agrees to follow the storage instructions provided (away from light and heat, box resealed after opening).

In the event of a defect, the Customer benefits from the legal warranties of conformity and against hidden defects, under the conditions set out in the French Consumer Code and Civil Code.

11. Liability

ELLADA undertakes to properly fulfil the sale. ELLADA cannot be held liable for consequences (delay, non-delivery) resulting from an error attributable to the Customer (incorrect address, incomplete details).

12. Force majeure

In the event of an unforeseeable or insurmountable event, ELLADA is released from its contractual obligations, in accordance with Article 1218 of the French Civil Code.

13. Consumer mediation

(Section to be finalised before going live: under Articles L616-1 and R616-1 of the French Consumer Code, any business selling to consumers must be affiliated with a consumer mediator listed by the CECMC, and name it here along with its website. This is a subscription ELLADA still needs to take out — see MIGRATION.md.)

In the event of an unresolved dispute with customer service, the Customer has the right to refer the matter free of charge to a consumer mediator.

14. Customer service

15. General provisions

The fact that either Party does not enforce a breach of these Terms by the other Party shall not be interpreted as a waiver. If any clause of these Terms is found invalid, the remaining clauses remain applicable.

16. Evidence

Electronic data (confirmation email, connection logs, timestamps) is admissible as evidence between the Parties. ELLADA retains contractual documents on a reliable, durable medium for the legal retention period.

17. Language and applicable law

The original text of these Terms is written in French. In case of translation, only the French version prevails. French law applies.

18. Complaints and disputes

For any complaint, the Customer should first contact customer service (article 14). Failing an amicable solution, and after possible recourse to the consumer mediator (article 13), the dispute falls under the jurisdiction of the competent French courts.
